Company Policies & Terms of Service

These policies outline Gotham Cigars’ terms of service, shipping and delivery guidelines, age verification requirements, return procedures, and customer responsibilities when purchasing tobacco products. By placing an order through our website, you agree to the policies and conditions described below.

GENERAL POLICIES

Gotham Cigars does not sell products to anyone under the age of 21.
Shipping delivery times are estimates only unless otherwise stated.
Some oversized items may incur additional shipping fees, which will be displayed at checkout before you complete your order.
We don’t ship orders on weekends or holidays.
Our cut-off time for same-day shipping is 12 PM EST Tuesday–Friday. Orders placed after 9 AM EST on Mondays depart the next business day (including rush orders).

SHIPPING & DELIVERY

Gotham Cigars ships within the 48 continental U.S.; additional fees apply to Alaska and Puerto Rico. We also ship to Canada.

Rush Orders: To guarantee same-day shipping, add Rush Order – SKU: HIGHPRT ($3.00) before completing checkout. Orders must be placed between Tuesday and Friday before 2PM EST. Orders placed after 9 AM EST on Mondays will ship the next business day, even with the rush option.

Carrier Schedule: UPS Ground runs Mon–Fri only; USPS delivers Mon–Sat. National holidays are not transit days.

Filtered & Little Cigars: These items can only be shipped through USPS and are not eligible for UPS delivery.

All APO, P.O. Box, U.S. Territories (Puerto Rico, Guam, US Virgin Islands) and Canadian orders are shipped via USPS.

Please note that weather conditions, mechanical issues, fraud or age verification, and other unforeseen factors may cause delays beyond our control. For the latest updates on service interruptions, visit the UPS or USPS websites.

STATE RESTRICTIONS

Specific limitations as dictated by individual states.

Arkansas

Due to Arkansas State Regulations, we do not ship nicotine pouches to Arkansas addresses.

California

While we require all purchasers to be over 21 years of age, California’s Senate Bill 39 requires us to:

Confirm your delivery of tobacco products by telephone call after 5PM (PT) the day prior to shipment
Obtain the signature of a person 21 years of age or order before completing the delivery

Note, in order to comply with this restriction, we are unable to ship to a PO Box or offer certain shipping methods to California.

Additionally, due to California State Regulations, we only ship Classic nicotine pouches.

Connecticut

Due to Connecticut State Regulations, we do not ship the following products to Connecticut addresses:

Small Cigars (Weighing 3lb per 1000 or less)

Delaware

Require the signature of an adult 21 years of age upon delivery.

Hawaii 

Due to Hawaii State Regulations, we do not ship any products to Hawaii addresses.

Maine

Due to Maine State Regulations, we do not ship the following products to Maine addresses:

Small Cigars (Weighing 3lb per 1000 or less)

Due to Maryland State Regulations, we do not ship the following products to Maryland addresses:

Massachusetts

Due to Massachusetts State Regulations, we do not ship any Flavored Tobacco products to Massachusetts addresses.

Additionally, we only ship Classic nicotine pouches to Massachusetts addresses.

Montana

Due to Montana State Regulations, we do not ship the following products to Montana addresses:

Due to Pennsylvania State Regulations, we do not ship the following products to Pennsylvania addresses:

Small Cigars (Weighing 4lb per 1000 or less) in carton packs, containing 20 to 25 sticks per pack.

Rhode Island

Due to Rhode Island State Regulations, we do not ship any nicotine pouches to Rhode Island addresses.

South Dakota

Require the signature of an adult 21 years of age upon delivery.

Utah

Due to Utah State Regulations, we do not ship any products to Utah addresses.

Vermont

Due to Vermont State Regulations, we do not ship the following products to Vermont addresses:

Small Cigars (Weighing 4.5lb per 1000 or less)

Additionally, we do not ship nicotine pouches to Vermont addresses.

Washington

Due to Washington State regulations, we cannot ship the following products to Washington addresses:

Small Cigars (Weighing 3lb per 1000 or less)

Washington DC

Due to Washington DC regulations, we only ship Classic nicotine pouches.

CANADIAN SHIPPING POLICY

Shipping little cigars to Canada from the USA requires the receiver to pay duties and taxes, as they are not eligible for personal exemptions or gifts. The Canada Border Services Agency (CBSA) will assess duties, which include an excise tax (which as of early 2025 is $34.45873 per 1000 cigars) and an additional 88% duty on the duty-paid value of imported cigars, and other provincial taxes like Québec's 80% tax.

Refused packages incur a 20% restocking fee; shipping is non-refundable.

Canadian shipments use USPS Priority Mail International (ETA 2–6 weeks). Customs may hold packages up to 3 weeks. Limit four units of tobacco (200 sticks per unit) per box. Duties/taxes are the buyer's responsibility.

PAYMENT, PRICING & TAXES

We accept PayPal, Venmo, Visa, Mastercard, Discover, and American Express.

Credit/debit transactions may show a temporary pending authorization before final capture upon shipment.

We are required to collect a 7% Florida State Sales Tax for all orders shipped anywhere within Florida.

Prices and promotions may change without prior notice.

AGE VERIFICATION

All customers must be 21 years or older. Verification is powered by Agechecker.net at checkout. Most approvals are instant. If your billing data does not match, you may upload a photo ID. Data is secure and used only for age confirmation.

ORDERING & CANCELLATIONS

Orders begin processing immediately. To cancel or edit, contact us within 1–2 hours. Weekend orders must be canceled by Monday morning. Once shipped, orders cannot be changed or canceled.

First-Time Orders: Billing and shipping addresses must match. Unconfirmed orders after 3 business days are canceled and refunded. PayPal orders must ship to the verified PayPal address. For security reasons, we do not ship first-time orders over $250 to help protect against potential fraud.

PRIVACY & DATA USE

Gotham Cigars values your privacy and will never sell, rent, or lease your personal information to third parties.

All transactions are protected with up to 256-bit SSL encryption and verified by a GoDaddy Web Server Certificate. Payments are processed securely through Authorize.Net.

We collect names, shipping and billing addresses, contact details, age-verification data, and order history. This data is used solely to process purchases, verify eligibility, improve service, and comply with legal requirements.

Data Retention: Retained only as long as necessary to fulfill orders and meet obligations.
Your Rights: You may request access, correction, or deletion of your data (subject to legal limits).
Security: Technical and administrative safeguards prevent unauthorized access.

Prices listed at www.gothamcigars.com supersede any shown on third-party sites or feeds.
Promotions and coupon codes cannot be combined and are limited to one per customer.
Free-shipping promotions exclude Canadian orders unless stated otherwise.
